Effective date: [DD Month 2026] Last updated: [DD Month 2026]

1. Introduction and Acceptance

These Terms of Use ("Terms") govern your access to and use of the website of Jawaharlal Nehru Institute of Arts and Science ("JNIAS", "the Institute", "we", "us" or "our"), at [www.jnias.com], together with its sub-pages, enquiry and admission forms, My Privacy account area, downloads, and related online services (the "Platform").

By accessing or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our Cookie Policy. If you do not agree, please do not use the Platform.

These Terms constitute an electronic record under the Information Technology Act, 2000 and the rules made under it. They do not require any physical or digital signature.

If you are under eighteen (18) years of age, you may use the Platform only with the knowledge and supervision of a parent or lawful guardian, who is responsible for your use of it.

2. About JNIAS

JNIAS is a private, unaided arts and science college affiliated to Mahatma Gandhi University, Kottayam, and managed by the People Educational & Welfare Trust.

The Platform provides information about the Institute, its departments, programmes, facilities, admissions, activities, and notifications, and lets visitors send enquiries, submit applications, and manage their privacy choices.

3. Eligibility and Use of the Platform

You may use the Platform only for lawful purposes and in accordance with these Terms and all applicable laws of India.

You agree to give accurate, current, and complete information in every enquiry, form, or application, and to update it if it changes. Providing false, misleading, or forged information or documents may lead to rejection of an application, cancellation of admission, and legal action.

You must not submit another person's personal data unless you are authorised to do so.

4. My Privacy Account and Security

Some parts of the Platform, such as My Privacy, require you to create an account and verify your email address.

You are responsible for keeping your login details, passwords, and one-time codes confidential, and for all activity under your account. Please do not share them with anyone.

Please tell us immediately through the Privacy Support page if you suspect unauthorised access to your account.

We may suspend or close an account that we reasonably believe has been compromised, is being misused, or has breached these Terms.

5. Acceptable Use

When using the Platform, you must not:

  • Violate any applicable law, regulation, or the rights of any person;
  • Impersonate any person or misrepresent your identity, qualifications, or affiliation with the Institute;
  • Upload, post, or transmit any content that is unlawful, defamatory, obscene, abusive, harassing, discriminatory, or threatening, or that infringes any intellectual property or privacy right;
  • Introduce viruses, malware, or any code intended to damage, interfere with, or gain unauthorised access to the Platform or its servers;
  • Attempt to bypass, probe, or test the security of the Platform, or access areas or data you are not authorised to access;
  • Use bots, scrapers, or automated tools to extract content or data in bulk without our written permission;
  • Overload or disrupt the Platform or the networks connected to it;
  • Send spam, unsolicited promotions, or bulk messages through our forms or contact channels; or
  • Use the Platform to collect personal data about others without their consent.

We may remove content, restrict access, or report misuse to the authorities where we believe these rules have been broken.

6. Intellectual Property

All content on the Platform, including text, logos, names, graphics, images, photographs, videos, layouts, software, and the overall design ("Content"), is owned by or licensed to JNIAS or the People Educational & Welfare Trust, and is protected by the Copyright Act, 1957, the Trade Marks Act, 1999, and other applicable laws.

"JNIAS", the Institute's name, and its logos are the Institute's marks. You may not use them without our prior written permission.

We grant you a limited, non-exclusive, non-transferable, revocable permission to view the Platform and to download or print Content for your personal, non-commercial use, such as reading about admissions, provided you keep all copyright and ownership notices intact.

You must not copy, reproduce, modify, distribute, publish, sell, or create derivative works from the Content, or use it for any commercial purpose, without our written permission.

If you send us feedback, suggestions, or testimonials, you allow us to use them to improve the Platform and, where you have agreed, to publish them. You keep ownership of anything you create, but you must have the right to share it.

If you believe that content on the Platform infringes your rights, please write to the Grievance Officer with details of the work, the location of the content, and proof of ownership, and we will review the complaint promptly.

7. Information on the Platform

We try to keep the information on the Platform accurate and up to date, but we do not guarantee that it is always complete, current, or error-free.

Details such as course availability, intake, eligibility, fees, scholarships, academic calendars, facilities, and regulatory approvals may change because of decisions by the University, regulators, or the Institute. The official notices, prospectus, and circulars of the Institute and the University prevail over the Platform if there is any difference.

Please confirm important details with the Admissions Office before acting on them. Nothing on the Platform is a guarantee of admission, placement, results, or any specific outcome.

The Platform's Disclaimer page gives further details.

8. Admissions, Applications, and Fees

Submitting an enquiry or application on the Platform does not guarantee admission. Admission is subject to eligibility, availability of seats, the rules of Mahatma Gandhi University and the government of Kerala, and the Institute's admission policy and verification of original documents.

Any fees, refunds, and cancellations are governed by the Institute's published fee structure and refund rules, as in force at the time of admission.

Where online payments are accepted, they are processed by authorised third-party payment providers. We do not store your card, net-banking, or UPI credentials. You should check payment confirmations and keep your receipts.

We may reject, defer, or cancel an application or admission if any information or document is found to be false or incomplete, or if the applicant does not meet the conditions of admission.

9. Third-Party Links and Services

The Platform may link to or embed third-party websites and services, such as video platforms, maps, social media, payment providers, or the University's website. These are provided for convenience only.

We do not control and are not responsible for the content, accuracy, security, or privacy practices of third-party sites. Your use of them is at your own risk and subject to their terms and policies. A link does not mean that we endorse the third party.

10. Privacy and Cookies

We process personal data in accordance with our Privacy Policy and the Digital Personal Data Protection Act, 2023. Please read it to understand how we collect and use your information and what rights you have.

The Platform uses cookies as explained in our Cookie Policy. You can manage your choices through the cookie banner and Consent Preferences page.

11. Disclaimer of Warranties

The Platform and its Content are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we make no warranties of any kind, express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Platform will be uninterrupted, timely, secure, or error-free, that defects will be corrected, or that the Platform or its servers are free of viruses or other harmful components.

12. Limitation of Liability

To the fullest extent permitted by law, JNIAS, the People Educational & Welfare Trust, and their trustees, officers, faculty, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive loss or damage, including loss of data, opportunity, or goodwill, arising out of or in connection with your use of, or inability to use, the Platform or any reliance on its Content.

Where liability cannot be excluded by law, our total liability to you for any claim relating to the Platform shall not exceed [the amount, if any, you paid to us through the Platform in the twelve (12) months before the claim arose / INR 1,000].

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud or wilful misconduct, or any non-waivable right you have as a data principal or consumer.

13. Indemnity

You agree to indemnify and hold harmless JNIAS, the People Educational & Welfare Trust, and their trustees, officers, faculty, employees, and agents from any claim, loss, liability, or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Platform, the information you submit, or your violation of any law or third-party right.

14. Suspension and Termination

We may suspend, restrict, or end your access to the Platform or your account at any time, with or without notice, if we believe you have breached these Terms, harmed the Platform or others, or acted unlawfully, or if we must do so to comply with the law.

You may stop using the Platform at any time and ask us to close your My Privacy account through the Privacy Support page.

Provisions that by their nature should survive termination, including those on intellectual property, disclaimers, limitation of liability, indemnity, and governing law, will continue to apply.

15. Changes to the Platform and These Terms

We may change, suspend, or discontinue any part of the Platform at any time, and we may update these Terms from time to time. The "Last Updated" date shows when they were last revised.

For material changes, we will give notice on the Platform. Your continued use of the Platform after the changes take effect means you accept the updated Terms.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of India, without regard to conflict-of-law principles.

If a dispute arises, the parties will first try to resolve it in good faith through discussion with the Institute's Grievance Officer.

If it cannot be resolved this way within [30] days, it shall be subject to the exclusive jurisdiction of the courts at [Idukki / Kattappana / Thodupuzha], Kerala, subject to any right you have to approach a statutory forum, such as the Data Protection Board of India, under applicable law.

17. General Provisions

  • Entire agreement. These Terms, together with the Privacy Policy, Cookie Policy, and Disclaimer, form the entire agreement between you and JNIAS about your use of the Platform.
  • Severability. If any provision is found invalid or unenforceable, the rest will remain in full force.
  • No waiver. Our failure to enforce any right or provision is not a waiver of it.
  • Assignment. You may not assign or transfer your rights under these Terms. We may assign ours to a successor or affiliated entity of the Institute.
  • Force majeure. We are not liable for any delay or failure caused by events beyond our reasonable control, including natural disasters, power or network failures, strikes, government action, or cyberattacks.
  • Notices. We may give notices by posting on the Platform, by email to the address you gave us, or through your My Privacy account.
  • Language. These Terms are written in English. Any translation is for convenience only, and the English version prevails.
